Please read this Terms of Service Agreement carefully. By using this website, mobile application ("App"), or ordering and using VSAFE® products such as smart lockers, door locks, drawer etc you agree to be bound by all of the terms and conditions of this Agreement.
OVERVIEW
This Terms of Service Agreement (the “Agreement”) governs your use of the website www.thevSAFE.com, the VSAFE® App, and VSAFE®'s offer of products (including smart lockers, door locks, drawer and etc) for purchase or rental. This Agreement includes policies and guidelines referenced below. VSAFE® reserves the right to change or revise this Agreement at any time by posting updates on the Website and App, with the revision date indicated at the top of this Agreement. Continued use of the Website, App, or Products constitutes your acceptance of any changes. If you do not agree to this Agreement, please terminate your use of the Website, App, or Products immediately.
SECTION 1 - PRODUCTS & SERVICES
Terms of Offer
This Website and App offer for sale certain products (the “Products”) and services, including smart lockers for secure storage of personal items. By placing an order for Products through this Website or App, you agree to the terms set forth in this Agreement.
Customer Solicitation and Opt-Out Procedure
Unless you notify our third-party call center reps, direct VSAFE® sales reps, or use our in-app settings, you agree to continue receiving communications from VSAFE®. You may opt-out via the link in any email solicitation, send your request to contact@thevsafe.com.
SECTION 2 - VSAFE® SMART LOCKER AGREEMENT POLICY
Locker Usage
- Purpose: VSAFE® lockers are for personal use to store valuables, documents, or other items as outlined by VSAFE®. Storage of prohibited items is strictly forbidden.
- App Dependency: Access to the locker is granted via the VSAFE® App, requiring compatible devices and internet/Bluetooth connectivity. The Customer is responsible for device compatibility and App updates.
Locker Access and Security
- Exclusive Access: The Customer has exclusive access to the locker through unique credentials and security measures (e.g., PIN, biometric access) managed by VSAFE®.
- Shared Responsibility: VSAFE® implements advanced security measures, but the Customer is responsible for securing their login credentials.
Prohibited Contents
Customers must not store:
- Flammable or hazardous items
- Perishable goods or living beings
- Firearms, explosives, or other weaponry
Violation may result in immediate termination of access and potential legal action.
SECTION 3 - FEES, CHARGES, AND TERMINATION
Fees and Payments
- Rental Fees: Lockers are subject to monthly or annual fees. Non-payment may restrict access until dues are cleared.
- Late Fees and Penalties: Late fees apply to overdue payments. Persistent non-payment may lead to Agreement termination and restricted locker access.
Termination of Agreement
- By Customer: Termination requires written notice and locker clearance.
- By VSAFE®: VSAFE® reserves the right to terminate the Agreement for non-compliance or misuse. Lockers must be vacated upon Agreement end unless renewed.
SECTION 4 - LIABILITY AND DISCLAIMER OF WARRANTIES
Limitation of Liability
- Products and Locker Liability: VSAFE® is not liable for any loss, theft, or damage to locker contents.
- Website/App Usage: VSAFE® disclaims liability for any damages arising from Website or App use, including interruptions or security issues.
- Insurance: The Customer is advised to obtain insurance for high-value items, as VSAFE® does not cover locker contents.
Disclaimer of Warranties
The Website, App, Products, and lockers are offered “As is” and “As available.” VSAFE® disclaims all implied warranties, including those of merchantability and fitness for a particular purpose.
SECTION 5 - USER RESPONSIBILITIES
Proper Use and Restrictions
- App and Website Usage: The Customer agrees to use the Website and App for lawful purposes and abide by all applicable laws.
- Prohibited Content Posting: Customers must not post unlawful or harmful content.
- Locker Maintenance: Customers must use the locker according to VSAFE® guidelines and report any unauthorized access or issues immediately.
Indemnification
The Customer agrees to indemnify VSAFE® and its affiliates against claims or damages arising from misuse of the Website, App, or lockers.
SECTION 6 - PRIVACY
VSAFE® prioritizes user privacy and data protection. Please refer to the VSAFE® Privacy Policy for more on data collection and usage on the Website, App, and locker services.
SECTION 7 - AGREEMENT TO BE BOUND
By using the Website, App, or renting a locker, the Customer acknowledges having read, understood, and agreed to all terms and conditions.
SECTION 8 - GENERAL PROVISIONS
Jurisdiction and Dispute Resolution
- Jurisdiction: Disputes arising from this Agreement are subject to the jurisdiction of Tamil Nadu courts.
- Arbitration: Unresolved disputes may proceed to arbitration under applicable Indian law.
Assignment and Entire Agreement
This Agreement, encompassing Website, App, and locker services, supersedes all prior agreements. Customers may not assign their rights, while VSAFE® may assign its rights as needed.
Statute of Limitations
Any claim or action related to the use of the Website, App, or lockers must be filed within one year of the event or be forever barred.
SECTION 9 - FORCE MAJEURE
VSAFE® will not be held liable for delays or non-performance due to events outside its control, including natural disasters, war, or other force majeure events.
By accessing the VSAFE® Website, using the App, or renting a locker, you agree to be bound by this Agreement and the terms of service herein.
